03 - 20 - 2014 Convicted man charged in 2011 fatal DUI could get new trial
[LS] - The defense attorney for 44-y/o Carl D. Briggs is requesting a new trial after a ruling by the PA Supreme Court last Oct. which could affect his client. Briggs was convicted for vehicular homicide involving the deaths of 64-y/o Bruce E. Kauffman and 63-y/o Judy K. Kauffman in a fatal DUI crash with their motorcycle near McVeytown in 2011. While Briggs is serving time in a Pittsburgh state prison, his attorney Joseph Amendola, requested a portion of trial transcript from a representative with Quest Diagnostics. Amendola had objected to that testimony because his client was not directly involved in the analysis the blood alcohol test Quest performed. Amendola said his client had a right to confront the those involved in the blood analysis under the 6th Amendment. A new trial would be granted by the Mifflin Co. DA should the court rule in favor of Briggs' case.
