05 - 01 - 2014 Court rejects the NCAA challenge to state law on PSU fines
[CDT] - A challenge, by the NCAA, to a 2013 state law preventing millions of dollars in sanctions imposed against PSU from leaving the state was ruled out Wednesday. It came in a simple one-sentence decision from the Commonwealth Court, denying the NCAAâs request to re-argue its preliminary objections in the case that backed the constitutionality of the Endowment Act. The act, passed last year, determines how to spend fine monies levied against PSU over the Jerry Sandusky child sexual abuse scandal. It calls for all the money to be spent on child-abuse prevention and awareness programs be kept in PA. Judge Dan Pellegrini's decision could be considered a victory for State Sen. Jake Corman and state treasurer Rob McCord, who together authored the bill & are seeking enforcement of the act.
